1. Who we are
JPV Business Solutions (also trading as JPV Industrial Psychologists) (“JPV”, “we”, “us” or “our”) is a firm of industrial psychologists based in Pretoria, South Africa. We provide medico-legal (industrial psychology) reports and mediation services. This policy explains how we collect, use, share and protect personal information when you use our website, www.jpv.co.za (the “Website”), and what your rights are under the Protection of Personal Information Act 4 of 2013 (“POPIA”). For the personal information described in this policy we are the “responsible party”.
This policy covers the Website only. Personal information that we receive from clients and their representatives in the course of our professional work (for example when preparing a report or conducting a mediation) is handled under our engagement terms and our professional duty of confidentiality.
2. The personal information we collect
Information you give us. If you use the contact form on the Website we collect your name, email address, telephone number (optional), the subject of your enquiry and your message. If you use the eBook download form we collect your name and email address. If you email or phone us we keep the details you give us, such as your email address and the content of your message.
Information collected automatically. When you visit the Website our web server and security software record technical information such as your IP address, the type of browser and device you use, the pages you request and the date and time of the request.
What we do not collect through the Website. The Website does not have user accounts, does not process payments and does not use advertising or analytics trackers. Please do not include health information, case details or other sensitive information about yourself or anyone else in the website forms. We will let you know how to send that information to us securely once we are in contact.
3. Why we use your information and our lawful basis
We use your personal information only for the following purposes, each of which is permitted by section 11 of POPIA: to respond to your enquiry or request and to take steps at your request before entering into an agreement with you (contract or consent); to send you the eBook you asked for (consent); to keep the Website secure, prevent spam and abuse, and keep it working properly (our legitimate interests); and to comply with our legal and professional obligations.
We do not sell your personal information. We do not send marketing emails through the Website and we will not add you to a mailing list or send you direct marketing unless you have given us your consent, which you may withdraw at any time. We do not make decisions about you by automated means.
4. Who we share your information with
We share personal information only where needed and only with service providers that act on our instructions (in POPIA terms, “operators”) or where the law requires it:
Our web hosting provider, which stores the Website and its server logs. Brevo, the email delivery service we use to make sure Website emails, such as your enquiry, reach our inbox; Brevo handles your name, email address and message while it delivers the email. Google, which supplies the fonts shown on the Website; when a page loads, your browser contacts Google and your IP address is visible to Google. Security tools running on the Website that help us block spam and attacks and that may check IP addresses against lists of known threats. Our professional advisers, and regulators, courts or law enforcement where we are required by law to disclose information.
The Website contains links to other websites, including our Facebook page and other organisations. Those websites have their own privacy practices and we are not responsible for them. We do not run Facebook or other social media tracking on the Website.
5. Transfers outside South Africa
Some of the providers named above (for example Brevo in the European Union and Google) may process information outside South Africa. In line with section 72 of POPIA, we only use providers that are subject to laws, binding rules or agreements that give a level of protection substantially similar to POPIA, or we transfer information with your consent or where it is necessary to deal with your request.
6. Cookies
The Website does not use advertising, tracking or analytics cookies. WordPress, the software that runs the Website, only sets cookies for our own staff when they log in. The pop-up that offers our eBook stores a small cookie or browser storage entry on your device so that it does not keep appearing after you have closed it or used it. You can block or delete cookies in your browser settings; the Website will still work.
7. How long we keep your information
We keep enquiries and eBook requests for as long as needed to deal with them and for up to 12 months afterwards. If your enquiry leads to an engagement, we keep the related records for the period required by law and professional record-keeping rules. Server and security logs are kept for a short period, normally up to 90 days. We delete or de-identify personal information when we no longer need it.
8. How we protect your information
We take reasonable technical and organisational steps to keep your personal information safe, as required by section 19 of POPIA. These include encrypted (HTTPS) connections, security software, spam protection, restricted access to the Website’s administration area and regular software updates. No online system is completely secure. If there is a security compromise that affects your personal information, we will notify the Information Regulator and you as required by section 22 of POPIA.
9. Your rights
Under POPIA you have the right to: ask whether we hold personal information about you and ask for a copy of it; ask us to correct or delete personal information that is inaccurate, out of date, incomplete, misleading or unlawfully obtained; object to the processing of your personal information; withdraw your consent at any time (this does not affect processing that already took place); and not to receive unsolicited direct marketing. You also have the right to complain to the Information Regulator and to go to court.
To use any of these rights, please contact our Information Officer using the details below. We may need to confirm your identity first, and we will respond within 30 days.
10. Children
The Website is not intended for people under 18 and we do not knowingly collect personal information from children through it. If you believe a child has sent us personal information, please contact us and we will delete it.
11. Changes to this policy
We may update this policy from time to time. The date at the top shows when it was last changed. Please check it now and then.
